Jurisdiction – a paradox

In 2013 – 2014 Hungary introduced new gambling licensing standards. International operators did not accept them, challenging them in the national court and the Court of Justice of the European Union (CJEU). 


The CJEU concluded that most of the articles of the Hungarian system concerning online casinos contradicted European Union laws. Therefore they are not applied in practice. 


The current Hungarian system of online and land-based casino licensing is the first precedent in world law where legislation regulating gambling is passed but not enforced. Most government regulations can be ignored with impunity. 


Since the new licensing regime does not yet exist, Hungary has a legal emergency. The current national legislation prescribing a detailed gambling licensing system is practically non-existent. The bylaws are not applied in practice. Therefore, casinos operate on licenses issued in foreign jurisdictions (cross-licenses).
